Jail for Sushma Swaraj

June 14, 2015

Clarification: In the post below, it may appear that I have used the two words absconder and offender synonymously. It is an oversight and my regrets for the same. The two words are not synonymous. I have not changed the post because it has been published and already read by many. Thanks.

The only question to be asked in this “Sushma Swaraj Scam” is whether Lalit Modi was a declared absconder at that time. If Gehlot in this news report has been quoted correctly, and if he is telling the truth, Lalit Modi was a declared absconder. Well…then Sushma Swaraj needs to immediately go to jail, for commiting crime of harbouring an offender. The UK State while allowing Modi to stay in the UK was actually harbouring an offender and, but for the soverign immunity, would be punishable as well under the Indian Law. Therefore, the only recourse available to the Indian State was to issue a diplomatic caveat. Sushma Swaraj’s action of unilaterally revoking that caveat while Lalit Modi was still an absconder is not only an abetment of the offence of harbouring an offender by the UK State but also an act of treason. There is no question of just a resignation; she ought to suffer prosecution and jail. WTF is Delhi Police waiting for now?

P.S.
By stating that the Delhi High Court later revoked the cancellation of Lalit Modi’s passport, Sushma Swaraj has also committed contempt of court by insinuating that the Delhi High Court gave its decision under the influence of her own decision to revoke the caveat, which certainly is not the case — probably the Delhi High Court was not even informed about the revocation of the caveat.

P.S.
BJP is turning out to be the worst. If the whole government made the decision to revoke the diplomatic caveat, issue a statement. But if Sushma Swaraj unilaterally made this decision, send her to jail immediately. Make a choice: amputate one arm or paralyse the whole body. This cancer has stung you; now even if the Congress plays scounderly as they usually do, there are many others who will ask questions.

P.S.
Till now no media statement has been issued either by the government or by Sushma Swaraj herself stating that the revocation of the diplomatic caveat was a government decision, not a unilateral one. The tweets of Sushma Swaraj per se are clear that the diplomatic caveat was revoked by her unilaterally. In such matters, non-issuance of a clarification statement tantamounts to admission of guilt by Sushma Swaraj.
